Terms of Service

By accessing or using the Aranx platform and services (the "Service"), operated by Kangar OÜ, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Kangar OÜ.

You must be at least 18 years of age and have the legal capacity to enter into binding agreements to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.

Aranx is an AI-powered content generation platform that provides automated blog content creation, keyword research, content scheduling, and publishing services. The Service uses artificial intelligence to generate SEO-optimized content based on your business context, target audience, and content preferences.

The Service is offered on a subscription basis. Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the applicable subscription rate.

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. We reserve the right to change subscription pricing with at least 30 days' prior notice.

We may offer a free trial period for new users. At the end of the trial period, your account will automatically convert to a paid subscription unless you cancel before the trial expires. We will notify you before the trial ends and any charges are applied.

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period.

All payments are non-refundable. No refunds or credits will be issued for partial billing periods, unused features, or content generation credits.

You retain full ownership of all content, data, and information you provide to the Service, including business descriptions, prompts, blog topics, and other inputs. You grant us a limited license to use this content solely for the purpose of providing the Service to you.

Kangar OÜ assigns all rights, title, and interest in AI-generated content produced by the Service to you. Once generated, the content is yours to use, modify, publish, and distribute without restriction. We make no claim of ownership over content generated for you through the Service.

AI-generated content is produced using machine learning models and may contain inaccuracies. We do not guarantee:

• The factual accuracy or completeness of generated content
• The uniqueness or originality of any output
• Specific search engine rankings or SEO results
• That content will be free from errors, biases, or hallucinations

You are solely responsible for reviewing, editing, and verifying all AI-generated content before publication. We strongly recommend reviewing every article before it goes live on your website.

You agree not to use the Service to:

• Generate illegal, harmful, threatening, or abusive content
• Create content that promotes hate speech, discrimination, or violence
• Produce spam, misleading, or deceptive content
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Build a competing service using outputs or data from the Service
• Generate content intended as medical, legal, or financial advice
• Violate any applicable laws or regulations
• Interfere with or disrupt the Service or its infrastructure

The Aranx platform, including its software, design, branding, documentation, and all related intellectual property, is and remains the exclusive property of Kangar OÜ. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

The Service integrates with third-party providers including OpenAI (for content generation), DataForSEO (for keyword research), and others. Your use of the Service is also subject to the terms and policies of these third-party providers. We are not responsible for the availability, accuracy, or practices of any third-party services.

The Service offers integrations with content management systems including WordPress (via our plugin) and Shopify. These integrations enable automated content publishing to your website. You are responsible for ensuring that your use of our CMS integrations complies with the terms of service of the respective CMS platform. We are not liable for any issues arising from CMS platform changes, plugin conflicts, or publishing errors.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in our Privacy Policy.

You may cancel your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms, engage in prohibited uses, or if we reasonably believe your continued use poses a risk to the Service or other users.

Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will remain in effect.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, nor do we guarantee any specific search engine rankings or SEO results.

To the maximum extent permitted by applicable law, Kangar OÜ's total liability for any claims arising out of or related to the Service shall not exceed the total amount you paid to us during the twelve (12) months immediately preceding the event giving rise to the claim. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action or theory of liability.

You agree to indemnify, defend, and hold harmless Kangar OÜ, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, your content, or your violation of any rights of a third party.

Any disputes arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the Harju County Court (Harju Maakohus) in Tallinn, Estonia. Before initiating formal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of at least 30 days.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions. Where applicable, the provisions of the European Union regulations, including the GDPR, shall apply.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kangar OÜ regarding the Service.

Changes to Terms: We may update these Terms from time to time. Material changes will be communicated with at least 30 days' notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
